Agreement to Terms
These Terms of Service ("Terms") govern your use of Mile High 3D Scanning's website and 3D laser scanning services. By engaging our services or using our website, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use our services.
Important Service Scope Limitation
Mile High 3D Scanning provides scanning and documentation services only. We do not provide engineering analysis, certified measurements, or stamped drawings. All deliverables are for informational purposes.
Services we do NOT provide include:
- Engineering analysis
- Certified measurements
- Regulatory compliance documents
- Stamped drawings
Services Description
Mile High 3D Scanning provides 3D laser scanning, LiDAR scanning, and point cloud services for commercial and industrial clients. Our services include:
- On-site 3D laser scanning and data capture
- Point cloud registration and processing
- CAD drawing creation from point cloud data
- BIM model development
- Data delivery in various file formats
Specific services, deliverables, timeline, and pricing are defined in individual project quotes and agreements.
Project Quotes and Agreements
Before beginning work, we provide written quotes detailing:
- Scope of work and areas to be scanned
- Deliverable specifications and file formats
- Project timeline and milestones
- Pricing and payment terms
- Assumptions and exclusions
Your written acceptance of a quote (email confirmation is acceptable) constitutes agreement to proceed under the terms specified in that quote and these Terms of Service.
Payment Terms
- Deposit: A deposit may be required for larger projects, as specified in the quote
- Payment Due: Remaining balance is due upon delivery of final deliverables unless otherwise specified
- Payment Methods: We accept payment by check, ACH transfer, or major credit cards
- Late Payment: Invoices not paid within 30 days may incur a late fee of 1.5% per month
- Delivery Hold: We reserve the right to withhold deliverables until payment is received
Client Responsibilities
To ensure successful project completion, clients agree to:
- Provide safe and reasonable access to areas to be scanned
- Ensure necessary permissions and authorizations for site access
- Communicate any known hazards or special requirements
- Provide accurate information about project requirements
- Review deliverables and provide feedback within agreed timeframes
- Notify us promptly of any changes affecting the project scope
Scope Changes
If project requirements change after quote acceptance, we will provide a written change order detailing the impact on scope, timeline, and cost. Changes will not be implemented until you provide written approval of the change order.
Cancellation Policy
- Before Scanning: Projects may be cancelled with full refund of any deposit if cancelled more than 48 hours before scheduled scanning
- Less Than 48 Hours Notice: Cancellation fee may apply to cover preparation and scheduling costs
- After Scanning: No refund for completed scanning work; partial deliverables may be provided for proportional payment
- Our Cancellation: If we must cancel for any reason, all deposits will be refunded in full
Intellectual Property and Data Ownership
- Client Ownership: Upon full payment, all project deliverables (point clouds, CAD files, models) become the property of the client
- Raw Data: Raw scan data may be retained by Mile High 3D Scanning for quality assurance and backup purposes
- Portfolio Use: We may request permission to use anonymized project images for marketing purposes; this is not required
- Third-Party Rights: Client warrants they have the right to commission scanning of the property or space
Limitation of Liability
Mile High 3D Scanning's liability is limited as follows:
- Our total liability for any claims arising from a project shall not exceed the amount paid for that project
- We are not liable for indirect, incidental, consequential, or punitive damages
- We are not responsible for errors or damages resulting from client misuse of deliverables
- Our deliverables are for informational purposes only and should not be relied upon for certified measurements or engineering decisions
Warranty and Accuracy
We warrant that our scanning services will be performed in a professional manner consistent with industry standards. Point cloud accuracy is typically within 1-3mm under normal scanning conditions, though actual accuracy depends on site conditions, equipment settings, and environmental factors. If you identify errors or issues with deliverables, notify us within 30 days and we will work to resolve them at no additional cost.
Indemnification
Client agrees to indemnify and hold harmless Mile High 3D Scanning from any claims, damages, or expenses arising from: (a) client's misuse of deliverables, (b) client's misrepresentation of authorization to commission scanning services, or (c) third-party claims related to client's use of project data.
Dispute Resolution
Any disputes arising from these Terms or our services shall first be addressed through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Denver, Colorado, in accordance with the rules of the American Arbitration Association.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions.
Changes to Terms
We may update these Terms from time to time. Continued use of our services after changes constitutes acceptance of the updated Terms. For ongoing projects, the Terms in effect at the time of quote acceptance will apply.
